EU REGULATION 261/2004 ESTABLISHING COMMON PASSENGER RIGHTS IN THE EVENT OF DENIED BOARDING, CANCELLATION OR LONG DELAY OF FLIGHTS

 

Summary

 

The author analyzes the EU Regulation 261/2004 establishing common rights of passengers in case of denied boarding, cancellation and long delay of flights. Bearing in mind that this is a supranational regulation, which contains elements of unification, Regulation 261/2004 is competitive regulation Montreal Convention of 1999, as passengers can claim damages under the provisions of Regulation 261/2004 and the provisions of the Warsaw system or the Montreal Convention, because standardized amounts established by Regulation 261/2004 are independent in the application of Montrel Convention. In this regard, and provides an overview of relevant administrative and relevant jurisprudence (in what is included and examination of the Court of the European Union).
