THE WORTH OF A HIJACKED ELECTORIAL VOTE

Summary

            In the European and American practice of exercising the voting right, understood as a separate, individual political right, there have been cases recorded of its illegitimate deprivation. In that sense, the practice of court protection of the voting right has already been established, resulting in financial compensation for intangible damage incurred to a citizen who is deprived of the right to vote. In the modern legal system of the Republic of Serbia one may also expect to encounter the demands for protection from citizens who have been illegitimately and illegally deprived of the right to vote, due to lack of accountability of the central government. Thus, it is necessary to take timely normative and corrective measures which will help Serbia harmonize its state and legal system with the international and European principles in this area.
