SERBIAN CONSTITUTION ON A TRIAL RUN

 

Summary

 

Five years after the adoption of the Constitution of the Republic of Serbia, there is more and more insufficiencies in it, that are showing on the daylight, which is actually the primarily motive for authors analyses presented in this work. The emphasizing of some basic and, at the same time, most controversial constitutional events and constitutional solutions, has been conducted. Among them, as a primery ones we could separate insufficiencies of very process of adoption of the Constitution, its preamble, and constitutional definition of the character of the State. However, author presents constituional imperfection of solving the problem of the nature of the MPs mandate. Its more than certain that list of these problems is much longer, but their presentation in this work is limited with emphasizing on fundamental principals on whom the Constitution is based on.
