CONCEPTUAL DEFINITION AND LEGAL NATURE OF PLEA BARGAINING
Summary
The author in the work deals with the conceptual definition of the plea agreement, which represents a legal transplant that takes an increasingly important place in the sphere of the criminal proceedings in Serbia. The work is structurally divided into several parts, whereby the author bypasses the classical systematic of the plea bargaining. So, the primary consideration is devoted to the relationship between plea agreement and the efficiency of the criminal procedure. The central part of the work is dedicated to determining the concept and legal nature of the plea bargaining. Introduced into legislation to relieve overloaded courts, the plea agreement justified the expectations and has increasingly application in the practice. It is visible from the results of the survey, which the author gives at the end of this work.
