POSSIBILITY OF PAYING EARNINGS IN CRYPTOCURRENCIES IN THE REPUBLIC OF SERBIA

Summary

Socio-economic conditions have always influenced the evolution of law, either in terms of recognizing the need for the adoption of new legal regulations, or as a measure of insufficient adequacy and efficiency of existing regulations in "shaping" the mentioned conditions and in that sense initiating the necessary changes. The above-mentioned interdependence of social circumstances both at the national and supranational level de lege lata, especially became actualized during the globalization of business and the expansion of information and communication technologies. Thus, under the influence of information and communication technologies, work became "digitalized", and legal thought was occupied by new topics. First, the issue of introducing certain elements from the digital sphere among the traditional elements of the employment contract "imposed" itself, and then it was necessary to consider the so-called "flexible forms of work" as an alternative to the well-known concept of work, employment relationship and employment contract. Precisely as an integral part of the consideration of the innovations in the content of the employment contract, the author analyzes in the paper the possibility, i.e. the permissibility and potential consequences of the payment of earnings in cryptocurrencies in the Republic of Serbia in relation to the stipulations of the Labor Law, the Law on Digital Assets and other relevant legal regulations.

Keywords: employment contract, earnings, cryptocurrencies, employer, employee.
