PUBLIC POLICY INSTITUTION IN THE MATTER OF RECOGNITION AND ENFORCEMENT OF FOREIGN COURT DECISIONS FROM THE ASPECT OF SERBIAN PRIVATE INTERNATIONAL LAW
Summary
The mechanism of recognition and enforcement of foreign court decisions is extremely important for the realization of international legal traffic and the cooperation between countries, international decision making harmony, but for the fulfillment of legitimate expectations of the parties. According to the rules of Serbian Private International Law, a foreign court decision is recognized in Serbia if there are no obstacles to it from the Law on Resolution of Conflict of Laws with Regulations of Other Countries (Serbian PIL Act). One of them is the contrast between foreign court decision and domestic public policy, i.e. the foundations of social structure established by the Constitution (article 91 of Serbian PIL Act). If such thing is established, the recognition can be denied. In this sense, the author of this paper dedicates special attention to the Public policy institution and the questions when and under which conditions it would be justified to apply the clause of public policy in delibation procedure.
