WHO IS LIABLE FOR DAMAGE IN MOTOR VEHICLE ACCIDENTS AND DETERMINATION OF COMPENSATION IN CASE OF A TRAFFIC ACCIDENT

            In this paper, the author considers  the issues of a person liable for damage caused by moving motor vehicle and types of compensations in cases of traffic accidents caused by moving vehicles.

            The first part of the paper deals with the civil liability of traffic participants, pecuniary and non-pecuniary damage and how those issues are solved by Law on Obligations. In the second part of this work it has been analyzed the way for assessment of pecuniary damage in case of a traffic accident and how the compensation for pecuniary damage should be weighted. The paper especially considers non-pecuniary damage in cases of a traffic accident caused by moving motor vehicle as well as the issue of monetary compensation awarded for non-pecuniary damage
